Tobacco marketing restriction legislation in Brazil and the tobacco industry strategy against it

Objective: My objective is to provide information about Brazilian legislation which bans advertising of products containing tobacco and requires that the packaging of such products include information and images related to the ill-effects these products cause. I will also address tobacco industry efforts to mount a constitutional challenge before the Brazilian Supreme Court (STF) to have that legislation ruled unconstitutional. The target public of my talk are people who are involved in the questions related to legislation concerning tobacco-origin products.

Methods: In the presentation, I will address the efforts of IDEC (The Brazilian Consumer Defense Institute), together with other non-governmental organizations and entities, in support of the constitutionality of the anti-tobacco legislation being challenged in the courts, including the means they have adopted and their legal arguments. I will also address the legal arguments the tobacco industry has used to challenge the constitutionality of this legislation.

Results: The efforts of IDEC and other entities to defend the legislation is to guarantee that it remains in effect and is recognized as constitutional. With this talk, I intend to present the facts of what is currently occurring in Brazil in the hope that other countries may gain from our experience
